Due to the enforcement of the law (that was passed in 1996) concerning fosse
septic systems, all installations should conform by the end of 2005, that is existing and new.
At the moment the SPANC (Service Public d'Assainissement Non Collectif) is
using a stealth system to enforce this. All new planning permission applications (renovations
or new builds) have to be accompanied by a soil study and comprehensive engineers report
showing the design of the required fosse septic installation. The new installation is
inspected during the construction period by the SPANC.
Existing installations are being inspected and the owners of those that do not
conform are being given certain time periods to be put right. When a client is purchasing a
property the notaire should question the vendor as to the condition of the fosse septic
installation and the response should be put into the purchase agreement. As a rule if a
property is older than 15 years the installation will not conform.
